Terms of Service

These Terms of Service ("Terms") constitute a legally binding agreement between you and BBALL DISTRICT LLC, an Ohio limited liability company doing business as DYK Ball ("we," "us," or "our"), governing your access to and use of the DYK Ball website, game, and related services (collectively, the "Service").

By creating an account, accessing, or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not use the Service.

You must be at least 13 years of age to create an account and use DYK Ball. If you are between 13 and 18 years old (or the age of legal majority in your jurisdiction), you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.

By using the Service, you represent and warrant that you meet the eligibility requirements described above and that the information you provide during registration is accurate, current, and complete.

• You are responsible for maintaining the confidentiality of your account credentials (email and password).
• You may only create and maintain one account per person. Multi-accounting is prohibited.
• You may not share, sell, or transfer your account to another person.
• You may not impersonate another person or misrepresent your identity through your username, display name, or profile information.
• You are responsible for all activity that occurs under your account. Notify us immediately if you suspect unauthorized access.

You agree not to engage in any of the following prohibited activities:

4.1 Fair Play

• Manipulating, forging, or spoofing game scores, percentile results, or leaderboard rankings by any means, including intercepting or altering API requests.
• Using bots, scripts, browser extensions, or automated tools to play the game, submit answers, or interact with the Service on your behalf.
• Exploiting bugs, vulnerabilities, or unintended behaviors in the Service instead of reporting them.
• Colluding with other users to manipulate ELO ratings, faceoff outcomes, or leaderboard positions.

4.2 Conduct

• Harassing, threatening, or abusing other users through friend requests, faceoff challenges, display names, or any other means.
• Posting offensive, obscene, or discriminatory content in usernames, display names, bios, or submitted prompts.
• Spamming friend requests, faceoff challenges, or support requests.

4.3 Technical Abuse

• Attempting to gain unauthorized access to other users' accounts, our servers, databases, or any non-public areas of the Service.
• Overloading, flooding, or otherwise interfering with the infrastructure or availability of the Service (denial-of-service attacks).
• Scraping, crawling, or programmatically extracting data from the Service beyond what is publicly available through normal use.

5.1 Our Content

The DYK Ball name, logo, visual design, game mechanics, scoring algorithms, and all original content created by us are our intellectual property or licensed to us. You may not copy, reproduce, distribute, or create derivative works from our content without prior written permission.

5.2 NBA Data

Historical NBA statistical data, player names, team names, and related trademarks used within DYK Ball are the property of the National Basketball Association and its licensors. DYK Ball is an independent fan-created trivia game and is not affiliated with, endorsed by, or sponsored by the NBA, any NBA team, or Basketball-Reference. Statistical data is used for educational and entertainment purposes.

5.3 User-Submitted Content

When you submit content to DYK Ball — including prompt suggestions, support requests, and feedback — you grant us a non-exclusive, worldwide, royalty-free, perpetual license to use, modify, adapt, and incorporate that content into the Service. You retain ownership of your original ideas, but we may use submitted prompts (with or without attribution, at our discretion) in daily lineups and faceoff pools.

6.1 Subscription

DYK Ball Ultimate is a paid subscription that unlocks additional features including historical lineups, 1v1 faceoffs, the ability to suggest prompts, and an ad-free experience. Subscriptions are processed through Stripe, a PCI-compliant third-party payment processor.

6.2 Billing & Renewal

• The monthly plan is $12.99 per month. The annual plan is $119.88 billed once per year (equivalent to $9.99 per month).
• Your subscription will automatically renew at the end of each billing period unless you cancel before the renewal date.
• Prices are listed in USD and may be updated from time to time. You will be notified of any price changes before your next billing cycle.

6.3 Cancellation & Refunds

• You may cancel your subscription at any time from your Membership Settings.
• Upon cancellation, you will continue to have access to Ultimate features until the end of your current billing period.
• Refund requests are reviewed on a case-by-case basis. Submit a Support Request if you would like us to review one.

6.4 Free Tier

The core DYK Ball experience — including the daily lineup, global leaderboards, DYK Rating, streaks, and public profiles — is and will remain free. No paywall gates the daily game.

7.1 By You

You may delete your account at any time from Account Settings. Account deletion is permanent and irreversible. App data such as your profile, scores, ratings, friends, and match history will be removed from our active database. We may retain limited payment, transaction, security-log, or backup records where reasonably necessary for legal, tax, fraud-prevention, security, or operational purposes.

7.2 By Us

We reserve the right to suspend or terminate your account, without prior notice, if we reasonably believe you have violated these Terms. This includes, but is not limited to, cheating, harassment, multi-accounting, or any form of abuse. We may also remove or reset scores, ratings, or other data that we determine were obtained through prohibited activity.

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not warrant that:

• The Service will be uninterrupted, secure, or error-free.
• Game scores, percentile rankings, or statistical data will be perfectly accurate at all times.
• The Service will meet your specific expectations or requirements.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, DYK BALL AND ITS OPERATORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• Your access to or use of (or inability to use) the Service.
• Any conduct or content of any third party on the Service.
• Unauthorized access, use, or alteration of your data or account.
• Loss of scores, ratings, streaks, or other gameplay progress.

Our total liability for any claim arising out of or relating to these Terms or the Service shall not exceed the amount you paid us (if any) in the twelve (12) months preceding the claim.

You agree to indemnify, defend, and hold harmless DYK Ball and its operators from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorney's fees) arising out of or in any way connected with your access to or use of the Service, your violation of these Terms, or your violation of any third-party rights.

These Terms are governed by the laws of the State of Ohio, without regard to conflict-of-law principles. Any dispute arising from these Terms or the Service will first be addressed through good-faith negotiation. If it cannot be resolved, the parties consent to the state and federal courts with jurisdiction over Wood County, Ohio, except where applicable consumer law requires otherwise.

We reserve the right to modify these Terms at any time. When we make changes, we will update the "Effective date" at the top of this page. Material changes may be communicated through an in-app notice. Your continued use of the Service after changes are posted constitutes your acceptance of the revised Terms.
